A.  Terms and conditions of use

1. Acceptance

On its v-traffic website (hereinafter the "Website"), Mediamobile offers a national traffic information service covering metropolitan France. The Website thus enables any user to check road conditions (free-flowing, dense, congested, at a standstill) and any incidents (accidents, traffic jams, road closures, road narrows, roadworks) that may occur on French roads. It also provides other useful information such as prices at service stations, availability of parking spaces, locations of bike-share schemes, weather, air quality, etc.

Any and all use made of the Website by the user implies that the latter accepts, without reservation, the Website's terms and conditions of use (hereinafter the "Terms").

The Terms may be modified and/or updated at any time and as often as necessary. Users are therefore advised to review the Terms regularly in order to ensure that they are familiar with the most recently updated version of the Terms.

2.  Rules of conduct and prohibited behaviour

2.1 Users may only use the Website and its contents for personal, non-commercial purposes. In this respect, users are authorised to consult the contents of the Website for their own personal needs, and to print out a single copy of the Website contents.

Any other use, reproduction or representation of the Website is prohibited without the prior written consent of Mediamobile. In order to obtain the latter, users may contact the webmaster of the Website via the "Contact us" tab. The webmaster is at liberty to accept or reject the submitted request. It is hereby noted that certain forms of use or uses may be permitted subject to payment of a fee to Mediamobile, especially where the Website and its contents are used for professional, commercial or organisational purposes.

Users are also enjoined to behave in a fair and honest manner when using the Website and its contents, and with this in mind shall undertake:

2.2 The Website and its contents are the property of Mediamobile and third-party partners as listed elsewhere in the Terms. The Website and its contents are thus protected by the laws pertaining to intellectual property. Consequently any use, reproduction or representation of the Website and its contents, in whole or in part, in any form or forms other than those specified herein, without the prior written agreement of Mediamobile and/or the other rights-holders concerned, is strictly forbidden.

The user shall therefore refrain from copying, broadcasting, displaying, transmitting, distributing, selling, granting, assigning, lending, sublicensing, modifying, adapting, integrating, extracting, or making any other commercial use of the aforementioned contents and the aforementioned Website, in whole or in part, in any manner whatsoever and in any form whatsoever, without the prior written permission of the rights-holders concerned.

With respect to any trademarks, logos and other distinguishing features (including visual identity and look & feel) belonging to Mediamobile or to a third-party partner (hereinafter "Distinguishing Marks"), the user is not permitted to make use of or otherwise exploit said Distinguishing Marks in any manner whatsoever or for any purpose whatsoever without the prior written consent of the owner of the Distinguishing Marks.

Requests to use any contents or Distinguishing Marks belonging to Mediamobile should be made in writing and sent by post to the webmaster of the Website. To make use of other contents and/or Distinguishing Marks, the user should approach the relevant rights-holder directly.

2.3 Any user who does not comply with the Terms of the present Article may be liable under civil and/or criminal law to action by the rights-holder.

3.  Liability and responsibility

3.1 Mediamobile makes every effort to provide users of the Website with comprehensive, high-quality, regularly updated information without errors or omissions, but can guarantee neither the accuracy nor completeness of such information, nor the efficient operation, quality or availability of the Website and its contents.

In consequence of which Mediamobile shall not be held liable in this respect.

It is thus incumbent upon users to verify such information by cross-referencing with any other available sources.

Mediamobile does not under any circumstances guarantee that the information provided shall be suitable or appropriate for the user's needs, consequently Mediamobile is unable to accept any claim for compensation for any loss or impairment suffered by the user following consultation of the Website and/or use of any information obtained through the Website.

Furthermore, Mediamobile shall not be held liable for any damages incurred by the user as a result of failure to comply with the obligations arising under these Terms.

Finally, in any and all cases, Mediamobile shall not be held liable for indirect damages incurred or suffered by a user in connection with use of the Website and/or the contents of the Website.

3.2 Portions of the contents are also provided by third-party partners of Mediamobile. These contents are the responsibility of their publishers (hence of said third-party partners) The user expressly acknowledges and agrees that Mediamobile cannot and shall not be held liable for any contents provided by such third-party partners and shall not be held liable for any loss or damages caused by such contents. In case of problems, the user should contact the publisher(s) of the respective content(s) directly using the hyperlinks (URLs) provided below.

4 Suspension and/or interruption of the Website

Under no circumstances shall Mediamobile be liable to the user for any suspension, interruption or discontinuation of the Website, and Mediamobile shall not be subject to any obligations with respect to the ongoing provision, quality or duration of the Website.

5 Termination

In the event that the user breaches or infringes on these Terms, Mediamobile reserves the right to suspend the user's access to the Website, notwithstanding the possibility that Mediamobile may choose to exercise and/or assert its other rights, including its right of redress.

B.  Privacy policy and cookies

Personal data collected on www.v-traffic.com through the exchange of electronic mail (e-mail) messages is protected under the provisions of Article 78-17 of the "Informatique et Liberté" (Data Protection) Act of 6 January 1978.

This personal data may be retained for a period not exceeding twelve (12) months from the last e-mail exchange.

In respect of such personal data, the user is entitled to access, modify, correct or delete said data by submitting a simple request to the following address:

Mediamobile undertakes not to communicate or transmit this data to third parties.

Users agree that, unless they explicitly object, any information and personal data collected through the Website may be used by Mediamobile solely for purposes of market research. With respect to geolocation data collected through the Website, such data is anonymous and is not retained by Mediamobile.

The Website (www.v-traffic.com) installs and uses cookies in order to optimise the performance of the Website and make use of the Website more intuitive for users.

These cookies do not and cannot be used to identify users of the Website and are anonymous. They may be used by Mediamobile solely for market research and statistical purposes.

Users may choose to delete the cookies by adjusting the appropriate settings in their browsers.

E. Governing law

Any failure by the user, regardless of his or her location, to comply with one or more provisions of these Terms (terms and conditions of use of the Website), and more generally, any difficulty arising in respect of their performance, interpretation or validity, shall be subject to the French courts under French law.
